X/POOLE/5293

CASE with the opinion of the Attorney General. Recites how in 1799 Cadwalader Owen and John Jones of Aberdeunant, timber merchants, contracted with John Lause of Liverpool, merchant, for sale of timber from Aberdeunant. The timber is packed and awaiting delivery but hearing the merchant is on the verge of bankruptcy they are afraid to deliver it without securing payment for it. The same merchants had an order for bark from Mr. Hutton in Dublin which he despatched by ship but for which the buyer is witholding part of the payment as he claims it was wet. Opinion is given on the two cases.
