CASE of Mr. Griffith Griffith with the opinion of J. Kyffin, junior. In 1740 Richard Knight, agent of Mr. James Griffith & Co., sent a cargo of ore, value £290, to Mr. Smedley, agent for the smelting house at Bagillt; he gave particular directions about the payment of the account. Mr. Knight later ordered the agent to pay £120 to Mr. Griffith Griffith; the agent had already paid out money contrary to order to another member of the company and only agreed to pay the sum after Mr. G. Griffith gave an undertaking that a further consignment of ore would be sent to him. The ore was not delivered; there was a dispute about the accounts over the £120 paid to Mr. Griffith Griffiths and a bill for recovery of the money was filed.
